Terms and Conditions

The PTC Binder™ App is created and published by UMANERA LLC, doing business as PTC Binder™ ("Umanera," "PTC Binder™," "we," "us," or "our").

This document (the "Agreement") sets forth the terms and conditions that govern your use of the app, services, and/or websites  offered by or through Umanera. Your use of any of our services will constitute acceptance of this Agreement and will have the same legal effect as if you were providing a handwritten signature of acceptance.

PLEASE READ CAREFULLY BEFORE USING PTC BINDER™. YOUR USE OF THE SERVICE OR ANY SERVICES PROVIDED THROUGH UMANERA IS SUBJECT TO THESE TERMS. YOU AGREE TO BE BOUND BY THE TERMS PRESENTED BELOW. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE ANY OF UMANERA'S SERVICES IN ANY WAY OR FOR ANY PURPOSE WHATSOEVER.

This Terms sets out the legal terms between you (either an individual or legal entity) and Umanera.

These Terms are accepted by you when you actually use PTC Binder™. You may print a copy of these Terms for your records. These Terms remain effective from the date of acceptance until terminated by you or us in accordance with this Terms.

You cannot accept these Terms if: (a) you are not lawfully entitled to use the Service under any applicable laws in the country or territory in which you are located, are a citizen and/or resident of; or (b) if you are not of legal age to form a binding agreement with us. By accepting these terms you acknowledge and agree that you have reached the age to enter into such binding agreement in the country in which you are located or are a citizen and/or resident of or that you have your parent or legal guardian’s permission if required by applicable law. It is your responsibility to ensure that you are legally allowed to enter into this Agreement and that you do not violate any applicable laws.

In some countries there exist legal and/or other restrictions on usage of PTC Binder™ and/or downloading, installing and/or using of products, portions of products, software which are or might be available through the Service. It is your responsibility to ensure that you comply with all applicable legal restrictions in your jurisdiction.

Children's Privacy

PTC Binder™ is a collector tool intended for users aged 13 and older. It is not directed at children. While some airlines distribute pilot trading cards as promotional items that may appeal to younger audiences, PTC Binder™ itself is designed as a cataloging and collection management tool for collectors, and is not designed or intended to attract children under 13.

We do not knowingly collect, solicit, or store personal information from children under the age of 13 (or the applicable age of digital consent in your country). If you are under 13, do not use PTC Binder™ or provide any information through the app or its services.

Users between the ages of 13 and 18 may use PTC Binder™ only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on their behalf.

If we become aware that we have inadvertently collected personal information from a child under the applicable age threshold, we will take prompt steps to delete that information. If you are a parent or guardian and believe your child has provided us with personal information, please contact us at hello@umanera.com and we will delete it promptly.

For users in the United Kingdom: PTC Binder™ acknowledges the UK Age Appropriate Design Code. We do not collect personal data from users we know to be under 18, and we do not design features intended to engage or retain child users.

For users in the European Union: The age at which a minor may consent to data processing varies by EU member state (between 13 and 16). If you are below the applicable age in your country, you must have parental consent before using PTC Binder™.

For users in Canada: We comply with PIPEDA and do not knowingly collect personal information from children without verifiable parental consent.

Our Services

The services offered by us (referred to as the "Services") include, but are not limited to, websites, mobile applications, software, and social media profiles owned, operated, or published by Umanera. While our primary contact address is hello@ptcbinder.com, please note that responses to your inquiries may come from hello@umanera.com, the official email address of UMANERA LLC. If you receive an email from hello@umanera.com in response to a message you sent to hello@ptcbinder.com, it is a legitimate communication from us. The scope of our Services may expand or change over time, and this Agreement applies to all current and future Services provided by or through Umanera, regardless of the medium or platform through which they are accessed. By using any of our Services, you agree to be bound by these Terms in their entirety.

Third-Party Services

Some of the Services made available by or through Umanera may be hosted, operated, or delivered — in whole or in part — by third-party platforms, providers, or organizations over which we have no ownership or control. These may include, but are not limited to, third-party websites, application stores, payment processors, social media platforms, and software tools. By accessing or using any such third-party service, you acknowledge and agree that you are also subject to the respective terms and conditions, privacy policies, and all other applicable policies of those third parties. We are not responsible for the practices, content, or policies of any third-party service, and your use of such services is solely at your own risk. The app may display content from select third-party partners, including but not limited to video thumbnails and links sourced from YouTube and other platforms. Such content remains the property of its respective owners and is subject to their terms of service. Where applicable, such content is displayed with permission. Availability of third-party content may change without notice.

Right to Refuse Service

We reserve the right to refuse service to anyone, anywhere, anytime, for any reason. Such as, but not limited to: using the app for unintended purposes, or abuse of the terms, as defined solely by PTC Binder™ at our discretion.

Electronic Communications

Sending emails to us constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on any of our services, satisfy any legal requirement that such communications be in writing.

Payment & Refunds

Some PTC Binder™’s services are provided through the Apple App Store on a free and paid basis. PTC Binder™'s rates for services are listed in the App and on the App Store. PTC Binder™ reserves the right to modify its rates at any time and/or to offer special promotions. PTC Binder™ can not issue refunds for services; Apple reserves this ability for themselves only. PTC Binder™ does not send invoices to its customers (since we are not the ones that bill you); Apple reserves this ability for themselves only. You have confidential access to your account balance information through the App Store. If you have a billing dispute, you must contact the App Store to seek a remedy.

New Features and Modifications to Terms of Service

We may from time to time introduce new features to the Service or modify or delete existing features. We will post any new or modified features when they become available, as well as any new or modified terms of this Agreement. Any new or modified terms will become effective for your use of the service upon your use of a new or modified feature to which the new or modified term relates.

Cancellation

You may discontinue Service at any time by contacting the App Store. You will not be entitled to any refund of unused balances if you discontinue service. Additionally, you will remain responsible for payment of all charges for services rendered up through the date you discontinue service.

Limited License

We grant to the end User a limited, non-sublicensable, non-exclusive and revocable license to access and make use of the PTC Binder™ website, the mobile application and the materials solely in accordance with, and subject to, these Terms and any other of our policies as said in PTC Binder™.

Except as otherwise expressly permitted by these Terms, you may not: collect, use, copy or distribute any portion of PTC Binder™ app, website or the Materials; resell, publicly perform or publicly display any portion of the Materials; modify or otherwise make any derivative uses of any portion of PTC Binder™, the Mobile applications or the Materials; use any “deep-link,” “page-scrape,” “robot,” “spider” or other automatic device, program, algorithm or methodology which perform similar functions to access, acquire, copy, or monitor any portion of PTC Binder™; use PTC Binder™ in a manner which results in the depletion of Web site infrastructural resources; download (other than page caching) any portion of PTC Binder™, the Materials or any information contained therein or use PTC Binder™ or the Materials other than for their intended purposes.

Any content you create within the app, including notes, images, and collection data, remains your property. We do not claim ownership over user-generated content. In the event the app is discontinued, you are responsible for exporting or backing up your own data.

Data Export and Import. PTC Binder™ allows you to export your collection data as a portable archive file (.ptcbinder), which contains your collection metadata, card photographs, and a spreadsheet summary. Once exported, these files are under your sole control and responsibility. We are not responsible for any data loss, unauthorized access, or misuse that occurs after you export or share your collection files. The import feature allows you to restore a collection from a previously exported archive, with the option to merge with or replace your current data.

Camera and Photo Library Access

By using the app, you may be prompted to grant access to your device's camera and photo library. This access is used solely to allow you to add images to your personal collection within the app and for no other purpose.

When you select or capture an image, the app only processes the visual pixel data of that image. No file metadata — including GPS location, timestamps, or any other information embedded in the photo file — is accessed, collected, or stored by us. Photos and images remain on your device and are synced exclusively to your personal iCloud account. We do not have access to, nor do we store, any images or photo data on our servers.

You may revoke camera and photo library access at any time through your device's settings. Doing so may limit certain features of the app.

Notices and Claims

We may give notice of a claim of copyright infringement to our users by means of a general notice on the Services, electronic mail to a user's email address in our records, or by written communication sent by mail. In accordance with the applicable law, we have adopted a policy of terminating, in appropriate circumstances and at the sole discretion of us, account holders who are deemed to be repeat infringers. We may also at our sole discretion limit access to the Services of PTC Binder™ and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

If you believe that anything on the Services infringes upon any copyright which you own or control, you may send a notification of such infringement to: hello@ptcbinder.com.

Links to Third Party Sites/Third Party Services

The services may contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of Umanera or PTC Binder™. We are not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. We are providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by us, of the site or any association with its operators.

Certain services made available via the services are delivered by third party sites and organizations. By using any product, service or functionality of the PTC Binder™ originating from the service, you hereby acknowledge their terms and conditions.

Use of Communication Services

The PTC Binder™ app may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, share materials via social media, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, "Communication Services"). You agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service.

By way of example, and not as a limitation, you agree that when using a Communication Service, you will not: defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others; publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, discriminatory, infringing, obscene, indecent or unlawful topic, name, material or information; upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents; upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer; advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages; conduct or forward surveys, contests, pyramid schemes or chain letters; download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner; falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded; restrict or inhibit any other user from using and enjoying the Communication Services; violate any code of conduct or other guidelines which may be applicable for any particular Communication Service; harvest or otherwise collect information about others, including e-mail addresses, without their consent; violate any applicable laws or regulations.

We have no obligation to monitor the Communication Services. However, we reserve the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. We reserve the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

We reserve the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in our sole discretion.

Always use caution when giving out any personally identifying information about yourself or your children in any Communication Service.

We do not control or endorse the content, messages or information found in any Communication Service and, therefore, we specifically disclaim any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. You are not an authorized PTC Binder™'s spokespersons, and your views do not necessarily reflect those of us.

Materials uploaded to or thorugh a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you upload the materials.

When you share content to external social media platforms using features within the app, you do so at your own discretion and responsibility. We are not liable for any content shared externally, and such sharing is subject to the terms and conditions of the respective social media platforms.

User-Generated Content on Social Media

If you publicly post, tag, or share content related to PTC Binder™ on any social media platform — including but not limited to using our official hashtags, tagging our accounts, or mentioning PTC Binder™ — you grant UMANERA LLC a non-exclusive, royalty-free, worldwide license to reshare, repost, or feature that content on our official social media accounts and marketing materials, with or without attribution.

We will never alter the meaning or context of your content when resharing it. If you would like us to remove reshared content, contact us at hello@ptcbinder.com and we will do so promptly.

We do not claim ownership over any content you create. This license applies solely to our right to reshare or feature your content in connection with promoting PTC Binder™, and does not transfer any ownership rights to us.

User-generated content that we reshare or feature remains subject to the terms and privacy policies of the platform on which it was originally posted.

Terminations of Terms

Without limiting other remedies, PTC Binder™ may suspend or terminate this Agreement with you, or may terminate or suspend your use of the Services at any time if: (a) you are in default of these Terms; (b) you are engaged in illegal actions, or infringe proprietary rights, rights of privacy, or intellectual property rights of any person, or any third party rights, or otherwise create risk or possible legal exposure for us; (c) required by applicable laws/regulations and within the time limits as required by such laws/regulations; (d) you are using PTC Binder™ as not originally intended; (e) you are abusing or otherwise causing extreme usage of PTC Binder™ services or resources, determined at our sole discretion; (f) we decide to cease offering the Services generally.

Upon termination of this Terms: (a) all licenses and rights to use the Services shall immediately terminate; (b) you will immediately cease any and all use of the Services. Any suspension or termination of this Terms will not affect your obligations to us under these Terms (including, without limitation, proprietary rights and ownership, indemnification and limitation of liability, confidentiality), which reasonably are intended to survive such suspension or termination. We reserve the right to change or modify any provisions of these Terms or guidelines governing your use of the Services, at any time in our sole discretion and without liability to users. Any such changes or modifications will be effective immediately upon posting of revisions on PTC Binder™. Your continued use of the Services following the posting of such changes or modifications constitutes your acceptance of the Terms. Therefore, you should frequently review these Terms or guidelines of PTC Binder™ in order to understand the terms and conditions applicable to your use of the Services. If you do not agree to any changes or modifications to these Terms or to any applicable policies or guidelines, your sole recourse is to stop using the Services.

EXCLUSION OF WARRANTIES, LIMITATION OF LIABILITY AND INDEMNITY

NO WARRANTIES: TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES PROVIDED “AS IS” AND USED AT YOUR SOLE RISK WITH NO WARRANTIES WHATSOEVER; WE DO NOT MAKE ANY WARRANTIES, CLAIMS OR REPRESENTATIONS AND EXPRESSLY DISCLAIMS ALL SUCH WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, WITH RESPECT TO THE SERVICES INCLUDING, WITHOUT LIMITATION, WARRANTIES OR CONDITIONS OF QUALITY, PERFORMANCE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR USE FOR A PARTICULAR PURPOSE. PTC BINDER™ FURTHER DOES NOT REPRESENT OR WARRANT THAT THE SERVICES WILL ALWAYS BE AVAILABLE, ACCESSIBLE, UNINTERRUPTED, TIMELY, SECURE, ACCURATE, COMPLETE AND ERROR-FREE OR WILL OPERATE WITHOUT PACKET LOSS, NOR DOES ADMINISTRATION WARRANT ANY CONNECTION TO OR TRANSMISSION FROM THE INTERNET.

NO LIABILITY: YOU ACKNOWLEDGE AND AGREE THAT WE SHALL HAVE NO LIABILITY WHATSOEVER, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER THEORY OF LIABILITY, AND WHETHER OR NOT THE POSSIBILITY OF SUCH DAMAGES OR LOSSES HAS BEEN NOTIFIED TO US, IN CONNECTION WITH OR ARISING FROM YOUR USE OF THE SERVICES PROVIDED TO YOU THROUGH PTC BINDER™. YOUR ONLY RIGHT OR REMEDY WITH RESPECT TO ANY PROBLEMS OR DISSATISFACTION WITH SUCH SERVICES IS TO IMMEDIATELY CEASE USE OF SERVICES.

FURTHERMORE, YOU ACKNOWLEDGE AND AGREE THAT NEITHER US NOR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION OR DELIVERY OF THE SERVICES SHALL BE LIABLE TO YOU, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER THEORY OF LIABILITY, AND WHETHER OR NOT THE POSSIBILITY OF SUCH DAMAGES OR LOSSES HAS BEEN NOTIFIED TO US, FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES; OR (B) ANY LOSS OF INCOME, BUSINESS, ACTUAL OR ANTICIPATED PROFITS, OPPORTUNITY, GOODWILL, OR REPUTATION (WHETHER DIRECT OR INDIRECT); OR (C) ANY DAMAGE TO OR CORRUPTION OF DATA (WHETHER DIRECT OR INDIRECT).

IF ANY THIRD PARTY BRINGS A CLAIM AGAINST US IN CONNECTION WITH, OR ARISING OUT OF: BREACH OF THESE TERMS; BREACH OF ANY APPLICABLE LAW OR REGULATION; YOUR INFRINGEMENT OR VIOLATION OF THE RIGHTS OF ANY THIRD PARTIES (INCLUDING INTELLECTUAL PROPERTY RIGHTS), YOU WILL INDEMNIFY AND HOLD US HARMLESS FROM AND AGAINST ALL DAMAGES, LIABILITY, LOSS, COSTS AND EXPENSES (INCLUDING REASONABLE LEGAL FEES AND COSTS) RELATED TO SUCH CLAIM.

Confidentiality and Security

We are committed to respecting your privacy and the confidentiality of your personal information. We will process your personal information, the traffic data, and the content of your communication(s) in accordance with our Privacy Policy (www.ptcbinder.com/privacy-policy). Please read it carefully before starting using the Services.

Trademark Disclaimer

PTC Binder™ and the PTC Binder™ logo are trademarks of UMANERA LLC. All rights reserved. Unauthorized use, reproduction, or imitation of these marks is prohibited.

We use airline logos and trademarks solely for identificatory and informational purposes to help users organize and catalog physical trading cards. All logos, trademarks, and brand names are the property of their respective airlines and or companies and are used here without affiliation, endorsement, or commercial intent.

We are not affiliated with, endorsed by, or sponsored by any airline or company. This app is an independent community tool for documenting collector items and does not represent or speak for any airline brand.

App Store Compliance

Acknowledgment of Apple 

This Agreement is between you and UMANERA LLC only, and not with Apple, Inc. ("Apple"). Apple is not responsible for the App or its content. As between UMANERA and Apple, UMANERA is solely responsible for the App and its content.

Maintenance and Support 

UMANERA, not Apple, is solely responsible for providing maintenance and support services for the App, to the extent required by applicable law or as described in this Agreement. Apple has no obligation whatsoever to provide any maintenance or support services with respect to the App.

Product Claims 

UMANERA, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including: (a) product liability claims; (b) any claim that the App fails to conform to applicable legal or regulatory requirements; and (c) claims arising under consumer protection, privacy, or similar legislation.

Intellectual Property Infringement 

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, UMANERA, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Miscellaneous

These Terms constitute relationship between you and us with respect to your use of the Services. If any provision of these Terms (or part of it), is found by any court or administrative body of competent jurisdiction to be illegal, invalid or unenforceable, then such provision (or part of it) shall be removed from the Terms without affecting the legality, validity or enforceability of the remainder of the Terms.

The failure by us to exercise, or delay in exercising, a legal right or remedy provided by these Terms or by law shall not constitute a waiver of PTC Binder™’s right or remedy.

We may make changes to these Terms from time to time and we will publish the changes at this link www.ptcbinder.com/terms-and-conditions. The changes will be effective when published. Please review the Terms on a regular basis. You acknowledge and agree that your express acceptance of the Terms or your use of the Services after the date of publication shall constitute your agreement to the updated Terms. If you do not agree with the amended Terms, you may terminate this Terms in accordance with the set forth below.

If we are unable to provide the Services as a result of force majeure, we will not be in breach of any of our obligations towards you under these Terms.

These Terms shall be governed by and interpreted in accordance with the laws of State of Washington without regard to its conflict of laws provisions. The exclusive jurisdiction and venue of any action with respect to the subject matter of these Terms will be the U.S. federal courts and state courts located in Washington, and each of the parties hereto waives any objection to jurisdiction and venue in such courts. However, we reserve the right to seek injunction relief in any jurisdiction when we deem it necessary.

This Terms were drafted in English (US). We may provide you with a translation of the English language version of these Terms. In the event of any inconsistency between a non-English version of these Terms and the English version, the English version shall prevail.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOU HAVE READ THESE TERMS AND UNDERSTAND ALL RIGHTS, OBLIGATIONS, TERMS AND CONDITIONS SET FOR PTC BINDER™. BY CONTINUING TO USE THE SERVICES YOU EXPRESSLY CONSENT TO BE BOUND BY THESE TERMS YOU GRANT US THE RIGHTS SET FORTH HEREIN.
